Obscura: Dark Codex Terms of Service
These Terms of Service govern your use of the Obscura app, codex systems, generated artwork features, subscriptions, and associated backend services.
1. Acceptance of Terms
By accessing or using Obscura: Dark Codex, you agree to these Terms. If you do not agree, do not use the app or related services.
2. Description of the Service
Obscura is a dark-fantasy exploration and codex experience that allows users to navigate a world, preserve relics, summon lore fragments, and request generated scene and relic-card artwork.
Some features rely on third-party infrastructure, AI providers, Apple platform services, or backend systems used to support the product.
3. Eligibility and Accounts
- You must comply with applicable laws and platform rules when using the service.
- You are responsible for maintaining access to your Apple account and device.
- You are responsible for activity that occurs under your account or session.
4. Subscriptions and Billing
- Paid features may be offered through auto-renewable subscriptions purchased via Apple In-App Purchase.
- Billing, renewal, cancellation, and refund handling are subject to Apple’s purchase systems and policies.
- Subscriptions renew automatically unless canceled through your Apple Account settings before renewal.
- Feature availability, generation quotas, and access limits may vary based on the subscription currently active on your account.
If the app is distributed through the Apple App Store, your use of the app may also be subject to Apple’s standard licensed application terms at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.
5. User Content and Generated Output
You remain responsible for the prompts, invocation text, saved fragments, preserved relics, and other materials you submit or create using Obscura.
- You must have the rights needed to submit any content you provide.
- You are responsible for reviewing generated outputs before use or distribution.
- You are responsible for ensuring your use of generated content is lawful and does not violate third-party rights.
Generated content may vary, may not be unique, and may occasionally be unavailable due to service limitations or provider constraints.
6. Acceptable Use
You agree not to:
- use the service to violate law, regulation, or third-party rights;
- abuse, overload, reverse engineer, or bypass service limits or security controls;
- use generated output in a misleading, fraudulent, abusive, or infringing way;
- submit prompts intended to create unlawful, hateful, or prohibited content; or
- submit content that you do not have permission to use.
7. Beta and Experimental Features
Certain Obscura features may be experimental, incomplete, or in active development. Generated scene systems, relic rendering, and progression mechanics may change without notice and may not function consistently across all environments.
8. Service Availability and Changes
We may add, remove, modify, suspend, or discontinue features at any time. We do not guarantee uninterrupted availability, and some features may change as the product evolves.
9. Intellectual Property
Obscura, including its branding, lore systems, visual presentation, and platform infrastructure, is owned by us or our licensors and is protected by applicable intellectual property laws.
These Terms do not transfer ownership of our software or service materials to you.
10. Disclaimers
Obscura is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not warrant that outputs will be uninterrupted, error-free, unique, or fit for a particular purpose without your review.
AI-generated outputs may contain inaccuracies, omissions, or stylistic variations. Users are responsible for reviewing any generated content before reuse or publication.
11. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities arising from your use of the service.
12. Termination
We may suspend or terminate access to the service if we believe you violated these Terms, created risk for the platform, or used the service unlawfully or abusively.
13. Governing Law
These Terms are governed by the laws of the jurisdiction in which the service operator is established, without regard to conflict of law principles.
